1.GENERAL INFORMATION

AgroSicilia OÜ products can be purchased at:
1. PRE-ORDER FOR Loyal Customer Program.
2. via E-SHOP.
The goods can be picked up from the warehouse at Pallast 16. The warehouse is open Monday to Friday from 10:00 to 19:00 and on Saturday from 10:00 to 15:00.

The response time is up to 3 working days.

2. PREFERENCES

AgroSicilia OÜ sends circulars and separate product catalogs to its regular customers 3-5 times a year with price list. Many products (cheese, creams, parts of pestos, marmalades, Modica Chocolate, lemons, etc.) only on pre-orders.
Delivery time approx. 3 weeks.
Pre-ordering by writing in free form at info@agrosicilia.eu
An invoice will be made according to the order.

3. E-SHOP
The goods can only be ordered in Estonia.

When buying from the e-store, you can choose between the following delivery methods:

• I’ll come back to Pallast 16 warehouse. Price: FREE
If the order is made before 13:00 you can come in the same day from 17:00.
If the order is made after 13:00 you can come in the next day from 10:00
The goods are delivered to the buyer indicated in the order or to the consignee of the ordered goods on the basis of the receipt.

• I order the Omniva parcel terminal. Price: 2.50 €
Delivery time up to 5 working days, mostly faster. When delivering the goods to the parcel terminal, the customer is sent an sms door code. The parcel is stored in a parcel terminal for 7 calendar days.

• I ordered the Itella SmartPOSTI parcel terminal. Price: 2.50 €
Delivery time up to 5 working days, mostly faster. The customer is informed by SMS about the arrival of the parcel. The parcel is stored in the parcel terminal 7 calendar days after sending the door code to the mobile phone

4. ORDERING IN E-SHOP

YOU WILL RECEIVE AN E-MAIL WITH THE NOTIFICATION THAT YOUR ORDER HAS BEEN SUBMITTED

5. RECEIPT

3.1 The goods can be paid by bank transfer.
3.2 When purchasing from the E-Shop, the cost of delivery is automatically.

6. RIGHT TO RETURN

The contracting authority has the right to cancel the order within 5 days after placing the order without disclosing the reason.

7. DATA PROTECTION

6.1 The personal data of the Client are processed in accordance with the Personal Data Protection Act.
6.2 AgroSicilia OÜ uses personal data for the provision, further development and personalization of services to the Consumer. Under these services, agrosicilia.eu website must focus on the sale of goods and the organization of personalized offers to consumers.
6.3 The consumer shall, by entering and authorizing the data, have the right to collect and process the personal data of the Consumer and to provide the logistics partner with the necessary information for the delivery of the goods.
6.4 AgroSicilia OÜ has the right to use the Consumer’s residence or address for sending advertising and other information to the Consumer.
6.5 The consumer has the right at any time to prohibit the collection and use of their personal data, unless this is necessary to recover a claim arising from the contract or the delivery of goods. The consent to the use of the above-mentioned personal data can not be reversed.

6.6 Electronic personal data will be used for direct mail only if the Consumer has given their consent to this on agrosicilia.eu website.
6.7 An encrypted communication with banking sites while purchasing, guarantees buyers’ credentials protection, agrosicilia.eu does not have access to buyers’ credentials.
6.8 AgroSicilia OÜ does not pass their customers’ personal data on to third parties.

8. OTHER CONDITIONS

7.1 RESPONSIBILITY AND FORCE MAJEURE:

7.1.1 AgroSicilia OÜ is liable to you and you are liable to AgroSicilia OÜ for any damage caused to the other party by violation of these conditions in the cases and to the extent provided by legislation of the Republic of Estonia.

7.1.2 AgroSicilia OÜ shall not be liable for any damage caused or delay in delivery of the product if the loss or delivery of the product is due to the fact that AgroSicilia OÜ could not induce and the oncoming of which AgroSicilia OÜ did not foresee or could not foresee (force majeure).
7.2 INFRINGEMENT OF OBLIGATIONS:
Breach of obligations is the non-fulfillment of the terms of the order or improper fulfillment of the conditions, including delay in execution.
7.3 LEGAL PROVISIONS FOR INFRINGEMENT OF OBLIGATIONS:
7.3.1If AgroSicilia OÜ has breached its obligations, the client may:

1) demand fulfillment of the obligation;
2) to refuse to fulfill its obligation owed;
3) demand compensation for damage;
4) withdraw from the contract or rescind the contract;
5) lower the price;
7.3.2 The Client may use, separately or in combination, all legal or contractual remedies, which may be used at the same time, in the event of a violation of the obligation, unless otherwise provided by law or the contract. In particular, the use of a remedy arising from a breach of obligations does not entitle the customer to claim compensation for damage caused by an infringement.

7.3.3 The Client can not rely on violation of the obligation by AgroSicilia OÜ and, as a result, not use legal remedies in so far as the violation was caused by his own act or the fact or event arising from him, which he is responsible for.
7.4 RIGHTS OF THE CUSTOMER IN THE DISPUTE SETTLEMENT

7.4.1 In the unresolved issues in these circumstances, the laws in force in the Republic of Estonia shall be applied.

7.4.2 Disputes arising from the ordering and purchasing of AgroSicilia OÜ products are settled by negotiation. If you fail to reach agreement, you have the right to appeal to the Consumer Protection Board or the court for the protection of your rights. Dispute resolution is based on the legislation in force in the Republic of Estonia.
